The Law Debt Collection Workers Must Follow
Collecting debt is not the easiest job. It is not the most fun, either. It is sometimes hard to know the best way to deal with a given consumer in order to maximize your chances of getting the debt paid. But it is also important that rules be followed. In terms of the law debt collection definitely has some guidelines.
Many people talk about being harassed for payment of an outstanding debt. Often this is just talk. It might just mean that the person feels guilty about not paying, so any contact from a collector is irritating. However, until the agency receives notice that the debtor wishes not to be contacted, they have the right to call and send letters at regular intervals. Problems arise when this is taken too far.
A collector cannot pester incessantly for payment. They need to maintain appropriate conduct, including refraining from any type of abusive or profane language. They need to inform the debtor of their rights, including the right to dispute the debt. If the debtor decides to do this, they must provide evidence of the debt.
Also, under the law debt collection cannot include any type of deception such as leading the debtor to believe that they are calling with a government agency or telling them that the balance they owe is higher than it really is.
Privacy is also an issue in debt collection. The collector is allowed to contact friends or family of the debtor only in trying to locate him, but is absolutely prohibited from sharing the reason for calling, or mentioning anything about the debt. Of course it is absolutely off limits to give any information to the media or to publish any information about the debtor on any sort of list of bad debts etc.
If it comes down to it in the end, when the matter needs to be turned over to the law debt collection workers need to be clear with the debtor about the fact that they will be taken to court. Also, the suit must be filed in the area where the debtor lives, so they will not need to travel excessively to court.
There are many regulations for collectors to keep in mind. Most of them, however, are common sense guidelines. For a good collector, it should not be too difficult to follow.
A good collector is one who works well with people. He is comfortable communicating with people from various backgrounds and can identify with them, earning their trust. He shouldn't be afraid to be firm, and sometimes very firm, but should have control over his temper. And honest person with these personality traits should have no problem following the law debt collection workers must follow.
