What Makes Debt Collection Legal?

Every company that offers their customers credit, including stores, banks, car dealerships and credit card companies, has a lot to deal with. Credit is difficult to regulate and requires various departments to deal with all the accounts and the problems that may arise with them.


Of course, when credit is first offered, it is assumed that the consumer will repay the debt in a timely way, and keep up with the payments agreed upon. However, this is not always how things turn out, and the companies find themselves dealing with overdue payments and even abandoned accounts.

When a debtor shows no sign of continued payment and does not respond to the company’s requests for payment, the account is often turned over to a collection agency. This is a company that specializes in collecting overdue debt from both individuals or companies.

Debt collection is an important and necessary part of the credit industry. Collectors have a system they follow to get the debtors to finally pay their financial obligations. Most of these collectors work in a professional way, but this is not true of all collectors or collection agencies.

The Fair Debt Collection Practices Act provides guidelines and reinforcement of rulse related to the collection of debt. To make debt collection legal, a company must follow these regulations. Fines are given to companies that break them, and the act also makes it possible for consumers to file suit against a debt collector if they feel those rules have been violated in regard to them.

Generally the collector sends letters and makes phone calls at intervals to the debtor, asking for payment of the debt. The ideal is for the matter to be resolved during these steps of the process. The best thing a debtor can do to make the process as smooth as possible is to be honest and open with the collector.

If a debtor refuses to pay or does not respond to a request for debt collection legal action may be taken. At this point a suit may be filed where the consumer lives, so are not required to travel long distances for hearings. Garnishment of wages is usually the toughest sentence that is given, and it means that the debtor's employer will take a percentage of their paycheck and pay it directly to the court, who will send it on to the collection agency.

In debt collection legal action should not be necessary. A smart debtor will do all they can to pay off the debt that they have accrued. This is important for their credit record and it is the best way to avoid the letters and phone calls from the debt collector that can cause a lot of stress.
