When Your Debt Goes To A Collection Agency

The experience of debt repayment is something many have come across. Whether it is a student loan, a mortgage or car loan, or just a credit card bill, making payments is a part of everyday life for most. However, when times get hard for an individual, and especially when the economy is in a bad state, paying off those bills can be a real nightmare.


When the debts are not cleared or repaid timely, there will some penalties to face up with. First there are late fees. If payments go unmade for an extended period of time, the account will be turned over to a collection agency.

Many credit companies have in their scope of organization their own collection departments or agency. This means that the account is given to the people who, instead of charging a late fee, in expectation of payment next month, contact the debtor and inform them that they must now pay off their debt.

If the company's collection department is not able to have the debt collected, or if the company does not have one, the debt can be transferred to a third party collection agency, who will take up responsibility to collect the debt from the debtor.

There are typically two ways the transfer of debt might be executed. Commonly, the credit company gives the debt to the collection agency on a „no collection-no fee” basis. This means that the agency will only be paid for actually collecting funds. They generally charge a fee of 15-35% of the amount collected.

The other way is for the collection agency to actually take over or buy the debt. They do this by purchasing the debt at a reduced price, and will make profit on anything that they collect above what they paid for that debt. This practice of „debt buying” is becoming more and more popular of late.

When the collection agency takes responsbility for the debt or has the debt, they initiate the process of getting the debtor to pay his debt. This usually includes various methods such as sending letters to the debtor demanding payment of the debt to the agency. They also contact the debtor by phone to discuss the debt and payment options.

Only at the last resort, when the collector comes to realize that the payments will not be made, legal action will be taken against a debtor to settle for the balance of the unpaid debt. This usually only happens when the debtor is unable to work out a solution, and when the amount of the debt is high enough.

Of course, it is everyone's interest that no debt is taken over by a collection agency whenever possible. Making regular payments is an important part of being financially responsible. For those who find themselves unable to meet the payment demands, instead of waiting until your debt is sent to a collector, it is far smarter to look for a better solution through debt counseling, debt management, or other of the various debt help resources available.
